NY Community Medicaid – a 2022 Update

NY Community Medicaid – a 2022 Update

New York State enacted a number of new laws and regulations regarding Community Medicaid services, although the pandemic has delayed the implementation of most of them.  Most important is the introduction of a “look back” period for Medicaid services in the community.

The look back is 30 months (2 ½ years) for transfers of assets made before someone applies for Community Medicaid.  Transferring assets would result in a “penalty period” during which the applicant would not be eligible for Medicaid to pay for their health care.

The new rules also change the process of becoming eligible for Medicaid, tighten the rules regarding who is eligible, institute new rules regarding whether or not to keep someone in their home, and more.

Mr. Cutner will discuss the new, more restrictive regulations, and review the current status of their implementation.
